"Judging Samuel Alito"Posted by Pejman Yousefzadeh on Sun Jan 08, 2006 at 03:30:07 PM EST
You know, I have little problem with editorials in favor of Judge Alito, but I do wish that people would back off from the whole "vote for Alito because he's not like that evil and nasty Bork" business. Let's be clear: Whatever your views on the nature of Robert Bork's jurisprudence--and reasonable people can disagree on whether said form of jurisprudence is appropriate--the attacks on Bork were a travesty, as largely revealed here. It asks too much of people in this day and age to have them continue to countenance the popular misconceptions about Bork's jurisprudence, as he was widely respected and liked by people with diverse views who genuinely were aware of the nature of his work and respected the seriousness of his mind even if they might have disagreed with him.
Don't get me wrong; in terms of the nature of the debate, saying "Alito is much more acceptable than Bork" launches a torpedo into the port side of any battleship-wannabe-tugboat with anti-Alito hands on deck. But the Blogosphere is not supposed to be merely concerned with the political battles of the moment. It is supposed to be concerned with history as well. And the remembrance of history is ill-served by the propagation of tired shibboleths long ago debunked. (Cross posted on RedState.)
