A Chequer-Board of Nights and Days

Conservative Agitation Over Miers

The story is here. And good; there should be agitation and I hope that right-of-center libertarians and libertarian-conservatives make their less-than-pleased voices heard . Maneuvers such as this selection make it appear that a Republican Administration is afraid to pick a clearly defined originalist/strict constructionist and that instead, we should settle for a cipher. And a cipher we have received. Now it will be even harder for Republicans to fight for originalist/strict constructionist values. Now we have to overcome the implicit presumption that those values are something to be ashamed of, something to be hidden, papered over or perhaps even skirted entirely via a "stealth" nominee.

But hey, Democrats are happy! And I guess that's why we tried to win the election of 2004--to please Harry Reid and Charles Schumer.
